Pension Systems an executed waiver of all benefits that might inure to the employee
under the Teachers' Retirement System. At the time, the employee shall become a
member of the Pension System for Teachers of the State of Maryland.

(c) (2) Each nonclerical and nonprofessional former CCB employee shall
receive service credit in the Pension System for Employees of the State of Maryland for
prior service as a member of a Baltimore City Retirement or Pension System. This credit
shall be applied upon transfer of contributions in accordance with paragraph (3) of this
subsection.

(3) (i) When a nonclerical and nonprofessional former CCB employee is
employed by the Baltimore City Community College, the employer contributions to the
Baltimore City Pension and Retirement Systems for the benefit of the employee shall be
transferred, with interest, to the Pension System for Employees of the State of Maryland.

(ii) The amount to be transferred shall be determined by actuarial
valuation, performed by the actuary under contract with the Board of Trustees of the
Maryland State Retirement and Pension Systems, and the cost of the valuation shall be
borne equally by both systems.

(iii) The employee's accumulated contributions to the Baltimore City
Pension and Retirement Systems, if any, shall be refunded to the employee upon request.

REVISOR'S NOTE: This section formerly was Art. 73B, § 3-506(a), (b)(2), and
(c)(2) and (3).

These provisions are not retained in the Code because they are apparently
obsolete. However, they are transferred to the Session Laws to avoid any
inadvertent substantive effect that their repeal might have.

The only changes are in style.

SECTION 9. AND BE IT FURTHER ENACTED, That Section(s) 9-101, 9-104,
and 9-106 of Article 73B - Pensions of the Annotated Code of Maryland be repealed and
reenacted, with amendments, and transferred to the Session Laws, to read as follows:

NONCONTRIBUTORY PLAN OF JUDGES' RETIREMENT SYSTEM

[9-101.] 1.

(a)     In this [subtitle] SUBHEADING the following words have the meanings
indicated.

(b)     "Contributory plan" means the contributory plan for payment of retirement
allowances to former judges and their spouses, provided for in this title.

(c)     "Court" means the Court of Appeals, Court of Special Appeals, circuit court
of a county, and the District Court of Maryland.

(d)     "Former judge" is a person whose service as a judge has terminated.

(e)     (1) "Judge" means a judge of a court.
