regulation that upon transfer of an employee the employers' and employees'
contributions with credited interest shall be transferred from the employees' retirement
system of Montgomery County to such other qualified retirement system.

(d) Professional and clerical employees of any library operating under the
provisions of this subtitle who are employed pursuant to a federal Comprehensive
Employment and Training Act (CETA) public service employment program are not
covered under the Teachers' Retirement System of the State of Maryland.

REVISOR'S NOTE: This section formerly was Art. 73B, § 3-504.

Former § 3-504 is not retained in the Code because it is apparently obsolete.
However, it is transferred to the Session Laws to avoid any inadvertent
substantive effect that its repeal might have.

The only changes are in style.

[3-505.] 5.

(a)     (1) Each regular employee of the University of Baltimore shall become a'
member of either the Employees' Retirement System of the State of Maryland or the
Teachers' Retirement System of the State of Maryland as a condition of employment. In
no event shall such employee receive credit for service performed with the University of
Baltimore prior to January 1, 1975.

(2) Any such employee, who on December 31, 1974, was receiving a
retirement allowance from any of the State retirement systems, shall on January 1, 1975,
have such allowance payments discontinued and the employee shall be restored to active
service in the appropriate State retirement system. The employee shall be reinstated with
all previous State service credit, and upon retirement, the employee's accumulation fund
shall be reduced by the total amount of pension and annuity payments made during the
employee's previous retirement period, unless the system is reimbursed for such payments
by the member.

(b)     (1) This subsection applies to the professional and clerical employees of
community colleges under the jurisdiction of the Maryland Higher Education
Commission, other than the Baltimore City Community College.

(2) All professional employees who entered into a contract of employment
prior to July 1, 1975, may join the Teachers' Retirement System as established and
maintained under this subtitle if any such employee elects to do so within one year
following July 1, 1976; or they may join an optional retirement program if adopted by the
board as provided in [Title 11 of this article] TITLE 30 OF THE STATE PERSONNEL AND
PENSIONS ARTICLE. All professional employees of a community college who enter into a
contract of employment after July 1, 1975, shall participate in the Teachers' Retirement
System or an optional retirement program if adopted by the board. Clerical employees
who entered into a contract of employment prior to July 1, 1975, may join the Teachers'
Retirement System if any such employee elects to do so within one year of July 1, 1976.
Clerical employees who enter a contract of employment after July 1, 1975, shall
participate in the Teachers' Retirement System. However, any eligible professional
employee who joined the Teachers' Retirement System in the period July 1, 1975, to June
