Ch. 6                                       1994 LAWS OF MARYLAND

(b)     Except as provided in subsection (c) of this section, each former Baltimore
City Jail employee shall remain a member of the Employees' Retirement System of the
City of Baltimore. The State shall contribute annually to the Employees' Retirement
System of the City of Baltimore the employer's cost of the pension coverage. This cost
shall be based on the contribution rate applicable to all other City employee members of
the system, expressed as a percentage of participating employees covered compensation.

(c)     Notwithstanding any other provision of State or local law, a former Baltimore
City Jail employee may elect to enroll in and become a new member of the Maryland
State Retirement and Pension Systems on July 1, 1991. Such a former City Jail employee
shall be entitled to a vested allowance, as provided for in the Employees' Retirement
System of the City of Baltimore, to be paid by the City system for service credited to the
system.

(d)     If a former Baltimore City Jail employee who has elected to enroll in the
Maryland State Retirement and Pension Systems, as provided in subsection (c) of this
section, is not eligible to receive a vested allowance from the Employees' Retirement
System of the City of Baltimore, the employee shall receive a cash payment from the City
system equivalent to the value of the employee's accrued benefit in the Employees'
Retirement System of the City of Baltimore, as determined by the City's actuary.

(e)     On retirement, a former Baltimore City Jail employee is entitled to health
insurance benefits as provided in § 8-111 of the State Personnel AND PENSIONS Article.

REVISOR'S NOTE: This section formerly was Art. 73B, § 1-507(a), (b), (d), and
(e) and the second sentence of (c).

These provisions are not retained in the Code because they are apparently
obsolete. However, they are transferred to the Session Laws to avoid any
inadvertent substantive effect that their repeal might have.

The first sentence of former Art. 73B, § 1-507(c) is revised in § 23-201(a)(ii)
and § 25-201(b) of the State Personnel and Pensions Article.

The only changes are in style.

SECTION 6. AND BE IT FURTHER ENACTED, That Section(s) 2-206 and
3-206 of Article 73B - Pensions of the Annotated Code of Maryland be repealed and
reenacted, with amendments, and transferred to the Session Laws, to read as follows:

RESTORATION OF MEMBERSHIP IN EMPLOYEES' RETIREMENT SYSTEM AND
TEACHERS' RETIREMENT SYSTEM

[2-206.] 1.

(a) A person may revoke the waiver of benefits the person filed under [§ 2-204(a)
or § 2-205(a) of this subtitle] § 22-212 OR § 22-213 OF THE STATE PERSONNEL AND
PENSIONS ARTICLE and join the Employees' Retirement System of the State of Maryland
on the terms and conditions that the Board of Trustees provides if:

(1) The person was a member of this retirement system;
