TITLE 36. SOCIAL SECURITY BENEFITS.

36-101. DECLARATION OF POLICY.

IT IS THE POLICY OF THIS STATE THAT THE BENEFITS AVAILABLE UNDER THE
FEDERAL SOCIAL SECURITY ACT SHALL BE PROVIDED TO THE EMPLOYEES AND

OFFICERS OF THIS STATE AND ITS POLITICAL SUBDIVISIONS AND TO THEIR

DEPENDENTS AND SURVIVORS.

REVISOR'S NOTE: This section is new language added to reflect the substance of
former Art. 89, § 30, which set forth the. policy of this State regarding social
security benefits for State and local governmental employees arid officers:

Revisor's Note to this title.

36-102. AGREEMENT AUTHORIZED.

AS AUTHORIZED BY FORMER ARTICLE 89, §§ 30 THROUGH 40 OF THE CODE AND
SUBJECT TO APPLICABLE FEDERAL LAW, THE SECRETARY OF PERSONNEL, ACTING
ON BEHALF OF THIS STATE, MAY ENTER INTO, CARRY OUT, MODIFY, OR TERMINATE
AN AGREEMENT WITH THE SECRETARY OF THE UNITED STATES DEPARTMENT OF
HEALTH AND HUMAN SERVICES TO EXTEND THE BENEFITS AVAILABLE UNDER THE
FEDERAL SOCIAL SECURITY ACT TO THE EMPLOYEES AND OFFICERS OF THIS STATE
AND ITS POLITICAL SUBDIVISIONS AND TO THE DEPENDENTS AND SURVIVORS OF
THOSE EMPLOYEES AND OFFICERS.

REVISOR'S NOTE: This section is hew language added to reflect the substance of
former Art. 89, §§ 30 through 40, which authorized this State to enter into an
agreement with the federal government to participate under the federal Social
Security Act and set out the parameters of the agreement, including coverage,
benefits, contributions, administration, conditions of participation, effective
dates; and other related provisions.

GENERAL REVISOR'S NOTE TO TITLE:

Former Art. 89, §§ 30 through 40, which authorized the execution and
administration of the Social Security Agreement between Maryland and the federal
government, are transferred to the Session Laws of Maryland.

As enacted by Ch. 304, Acts of 1951, the former provisions often duplicated the
federal Social Security laws relating to participation by State and local governments.
Maryland's Agreement was executed on December 3, 1951, arid became effective as of
June 1, 1951. In the years that followed, there were numerous changes in the federal
Social Security laws and modifications to Maryland's Agreement, but no corresponding
changes to the Maryland statute. Few changes to the Agreement have been made in
recent years and future changes are not anticipated because the provision of social
security benefits is primarily controlled by federal law. Accordingly, the former provisions
are preserved intact, but are effective only to the extent that they are consistent with
federal law and are currently applicable.
