WILLIAM DONALD SCHAEFER, Governor

Ch. 6

REVISOR'S NOTE: This subsection is new language added to avoid the repetition
of the lengthy reference to "the date that an eligible governmental unit
commenced or commences participation in the Local Fire and Police System".

Throughout this subtitle, references to "effective" dates are substituted for
former references to "approval" dates, for accuracy. A legislative body of an
eligible governmental unit may approve participation some time before that
participation takes effect.

Defined terms: "Eligible governmental unit" § 31-201
"Local Fire and Police System" § 20-101

(C)      ELIGIBLE GOVERNMENTAL UNIT.

"ELIGIBLE GOVERNMENTAL UNIT" MEANS A GOVERNMENTAL UNIT THAT IS
ELIGIBLE TO PARTICIPATE IN THE LOCAL FIRE AND POLICE SYSTEM UNDER § 31-202
OF THIS SUBTITLE.

REVISOR'S NOTE: This subsection is new language added to avoid the repetition
of the lengthy reference to "a governmental unit that is eligible to participate
in the Local Fire and Police System".

Defined term: "Local Fire and Police System" § 20-101

(D)     FIRE FIGHTER.

(1)      "FIRE FIGHTER" MEANS:

(I)       A PAID FIRE FIGHTER, AS DETERMINED BY THE ELIGIBLE
GOVERNMENTAL UNIT; OR

(II)     A PAID PARAMEDIC, AS DETERMINED BY THE ELIGIBLE
GOVERNMENTAL UNIT.

(2)      "FIRE FIGHTER" DOES NOT INCLUDE:

(I)       A VOLUNTEER FIRE FIGHTER; OR

(II)     A VOLUNTEER PARAMEDIC.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 73B, § 10-201(e).

In paragraph (2)(ii) of this subsection, the reference to a "volunteer
paramedic" is added to state expressly that which formerly only was implied -
i.e., that neither a volunteer fire fighter nor volunteer paramedic may
participate in the Local Fire and Police System.

Defined term: "Eligible governmental unit" § 31-201

(E)     LAW ENFORCEMENT OFFICER.

"LAW ENFORCEMENT OFFICER" MEANS AN INDIVIDUAL CERTIFIED BY THE
MARYLAND POLICE TRAINING COMMISSION AS A LAW ENFORCEMENT OFFICER.
