Similarly, subsection (b) of this section does not provide for a person who is
vested in a local pension system but who is not yet receiving a benefit on the
effective date. The General Assembly may wish to clarify the applicability of
these provisions.

In subsection (d)(1)(i) of this section, the general term "assets" is substituted
for the former reference to "cash and securities" for clarity. A local pension
system of a participating governmental unit may have other kinds of assets.

In subsection (d)(1)(ii) of this section, the references to "the relative shares of
the members" are deleted as included in the reference to the "accumulated
contributions of the members".

31-113. DUTIES OF FISCAL OFFICER.

THE CHIEF FISCAL OFFICER OF EACH PARTICIPATING GOVERNMENTAL UNIT
SHALL:

(1)      SUBMIT TO THE BOARD OF TRUSTEES THE INFORMATION THAT THE
BOARD OF TRUSTEES REQUIRES; AND

(2)      WITH RESPECT TO EACH EMPLOYEE OF THE PARTICIPATING
GOVERNMENTAL UNIT, CAUSE TO BE PERFORMED THE DUTIES THAT WOULD BE
PERFORMED BY THE HEAD OF A STATE UNIT EMPLOYING MEMBERS OF AN
EMPLOYEES' SYSTEM.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 10-107.

The defined term "participating governmental unit" is substituted for the
former reference to a "municipal corporation that approves the inclusion of its
officers and employees in the Employees' Retirement System and the Pension
System for Employees of the State of Maryland" for brevity.

In item (1) of this section, the reference to information "that the Board
requires" is added to state expressly that which formerly only was implied —
i.e., the information to be submitted by the participating governmental unit is
the information that the Board of Trustees requires.

In item (2) of this section, the former reference to "State service" is deleted as
implicit in the reference to "duties ... performed by the head of a State unit".
