EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, IF AN EMPLOYEE
OF A PARTICIPATING GOVERNMENTAL UNIT JOINS THE EMPLOYEES' PENSION
SYSTEM WITHIN 1 YEAR AFTER THE EFFECTIVE DATE, THE EMPLOYEE IS ENTITLED
TO SERVICE CREDIT FOR EMPLOYMENT WITH THE PARTICIPATING GOVERNMENTAL
UNIT BEFORE THE EFFECTIVE DATE.

(B) EXCEPTION.

IF AN EMPLOYEE OF THE BALTIMORE METROPOLITAN COUNCIL ELECTS TO
BECOME A MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM OR THE
EMPLOYEES' PENSION SYSTEM, THE EMPLOYEE MAY NOT RECEIVE CREDIT FOR
SERVICE FROM JULY 1, 1992, TO THE EFFECTIVE DATE UNLESS THE EMPLOYEE PAYS
TO THE BOARD OF TRUSTEES THE AMOUNT OF THE MEMBER CONTRIBUTIONS THE
EMPLOYEE WOULD HAVE MADE DURING THAT PERIOD, PLUS REGULAR INTEREST.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 10-103(a)(2) and (b).

In subsections (a) and (b) of this section, the references to "effective" dates
are substituted for the former references to "approval" dates for accuracy. See
§ 31-101(c) of this subtitle.

In subsection (a) of this section, the reference to "calendar", which formerly
modified "year" is deleted as unnecessary.

31-111. BENEFITS OF MEMBERS.

AN EMPLOYEE OF A PARTICIPATING GOVERNMENTAL UNIT WHO IS A MEMBER
OF ONE OF THE EMPLOYEES' SYSTEMS IS ENTITLED TO THE BENEFITS TO WHICH
STATE EMPLOYEES ARE ENTITLED UNDER THAT SYSTEM.

The reference to a "member" is substituted for the former reference to an
employee "on behalf of whom contributions are paid as provided in this
subtitle" for brevity.
