(III) MONTEBELLO UNIVERSITY EMPLOYEES AS DEFINED IN §
13-1C-01(G) OF THE EDUCATION ARTICLE WHO WERE EMPLOYEES OF THE
UNIVERSITY OF MARYLAND ON JUNE 30, 1992, AND WHO BECAME EMPLOYEES OF
THE UNIVERSITY OF MARYLAND MEDICAL SYSTEM CORPORATION IN ACCORDANCE
WITH § 13-1C-04 OF THE EDUCATION ARTICLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 10~101(e)(3)(xv) and (xvii), as they related to
limitations on employees of the University of Maryland Medical System
Corporation to participate in the Employees' Pension System.

This section is set forth as a substantive provision instead of a definition
because of the definition of "municipal corporation" in former § 10-101(e)
served as a substantive provision limiting eligibility for participation under this
subtitle.

Defined terms: "Employee" § 31-101

"Employees' Pension System" § 20-101
"Employees' system" § 31-101
"Member" § 20-101

31-108. ELECTION TO PARTICIPATE.

EXCEPT AS PROVIDED IN § 31-109 OF THIS SUBTITLE, AN EMPLOYEE OF AN
ELIGIBLE GOVERNMENTAL UNIT IS ENTITLED TO BE A MEMBER OF THE
EMPLOYEES' PENSION SYSTEM IF:

(1)      (I) THE EMPLOYEE IS NOT A MEMBER OF A LOCAL PENSION
SYSTEM; AND

(II) THE LEGISLATIVE BODY OF THE ELIGIBLE GOVERNMENTAL
UNIT APPROVES PARTICIPATION OF THE ELIGIBLE GOVERNMENTAL UNIT IN THE
EMPLOYEES' PENSION SYSTEM; OR

(2)      (I) THE EMPLOYEE IS A MEMBER OF A LOCAL PENSION SYSTEM;

(II)     AT LEAST 60% OF THE MEMBERS OF THE LOCAL PENSION
SYSTEM PETITION TO BECOME MEMBERS OF THE EMPLOYEES' PENSION SYSTEM;
AND

(III)    THE LEGISLATIVE BODY OF THE ELIGIBLE GOVERNMENTAL
UNIT APPROVES PARTICIPATION OF THE ELIGIBLE GOVERNMENTAL UNIT IN THE
EMPLOYEES' PENSION SYSTEM AS THOUGH THE LOCAL PENSION SYSTEM WERE NOT
IN OPERATION.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 73B, § 10-102(a) and, as it
related to the election of an eligible governmental unit to participate in the
Employees' Pension System, § 10-104(b).
