Ch. 6

This section is set forth as substantive provisions instead of a definition
because the definition of "municipal corporation" in former § 10-101(e)
served as a substantive provision limiting eligibility for participation under this
subtitle.

In items (1)(ii) and (2)(ix) of this section, the references to "municipal
corporation" are substituted for the former references to "incorporated
town", "town", and "municipality" for brevity and accuracy.

In subsection (2)(viii) of this section, the reference to "Article 83B, §
4-401(a)(1)(iii) of the Code" is deleted as unnecessary.

"Employees' system" § 31-101
"Person" § 20-101

31-103. LIMITATION ON NUMBER OF ELIGIBLE COMMUNITY ACTION AGENCIES.

A LEGISLATIVE BODY MAY NOT DESIGNATE MORE THAN ONE COMMUNITY
ACTION AGENCY AS AN ELIGIBLE GOVERNMENTAL UNIT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 10-101(e)(3)(xii), as it related to the
limitation on the number of community action agencies that may be
designated by a legislative body.

The reference to "Article 83B, § 4-401(a)(1)(iii) of the Code" is deleted as
unnecessary.

Defined terms: "Eligible governmental unit" § 31-101
"Legislative body" § 31-101

31-104. ELIGIBLE EMPLOYEES OF BALTIMORE METROPOLITAN COUNCIL.

THE ONLY EMPLOYEES OF THE BALTIMORE METROPOLITAN COUNCIL WHO
ARE ELIGIBLE TO PARTICIPATE IN THE EMPLOYEES' SYSTEMS UNDER THIS
SUBTITLE ARE THOSE EMPLOYEES WHO WERE MEMBERS OF THE EMPLOYEES'
RETIREMENT SYSTEM OR THE EMPLOYEES' PENSION SYSTEM AS EMPLOYEES OF
THE BALTIMORE REGIONAL COUNCIL OF GOVERNMENTS ON JUNE 30, 1992.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 10-101(e)(3)(xvi), as it related to a limitation
of the employees of the Baltimore Metropolitan Council who were eligible to
participate in the employees' systems.
