The reference to the "legislative body of a municipal corporation" is
substituted for the former reference to the "city council, town council,
president and commissioners, burgess and commissioners (or by whatever
other name the legislative body of any incorporated town, city, or municipality
may be known)" for brevity since a municipal corporation is a town or city that
is incorporated as provided in Md. Constitution, Art. XI-E and Art. 23A of
the Code.

The former reference to "any public library association or organization and
any fire department receiving part or all of its funds from or through any
county, incorporated town, or municipality, or special taxing area, or other
political subdivision of the State" is deleted as included in the reference to an
eligible governmental unit.

(H) LOCAL PENSION SYSTEM.

"LOCAL PENSION SYSTEM" MEANS A RETIREMENT OR PENSION SYSTEM OF AN
ELIGIBLE GOVERNMENTAL UNIT THAT EXISTS BEFORE PARTICIPATION BY THE
GOVERNMENTAL UNIT IN THE EMPLOYEES' SYSTEMS.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 73B, § 10-104(a).

The scope of this definition is expanded to apply to the whole subtitle to avoid
the lengthy repetition of the reference to "a retirement or pension system of
an eligible governmental unit".

31-102. ELIGIBLE GOVERNMENTAL UNITS.

SUBJECT TO § 22-202(B) OF THIS ARTICLE, THE GOVERNMENTAL UNITS THAT
ARE ELIGIBLE TO PARTICIPATE IN THE EMPLOYEES' SYSTEMS ARE:

(1)      A POLITICAL SUBDIVISION OF THE STATE, INCLUDING:

(I)       A COUNTY;

(II)     A MUNICIPAL CORPORATION; AND

(III)    A SPECIAL TAXING AREA; AND

(2)      THE FOLLOWING GOVERNMENTAL UNITS:

(I)       AN AGENCY ON AGING, AS DESIGNATED BY THE LEGISLATIVE
BODY OF THE AGENCY ON AGING;

(II)     THE ALLEGANY COUNTY TRANSIT AUTHORITY;
