1994 LAWS OF MARYLAND

IF THE BOARD OF TRUSTEES PAYS AN ALLOWANCE UNDER THIS SECTION TO
MORE THAN ONE CHILD, THE BOARD OF TRUSTEES SHALL DIVIDE THE ALLOWANCE
AMONG THE CHILDREN UNDER THE AGE OF 18 YEARS IN A MANNER THAT
PROVIDES FOR PAYMENTS TO CONTINUE UNTIL EACH CHILD DIES OR BECOMES 18
YEARS OLD.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 6-411(b)(l).

In subsection (a) of this section, the reference to an individual who dies "while
employed as a member of the State Police Retirement System" is substituted
for the former reference to "member in service" to reflect that "service" is no
longer a defined term.

In the introductory language of subsection (b) of this section, the former
references to the "proper" proof and the "certification" of death are deleted
as implied in the reference to a finding of death by the Board of Trustees.

In subsection (b)(1)(i) of this section, the reference to "the person having an
insurable interest in the life of the deceased" is deleted to conform to similar
provisions in this Division II.

             Subsection (c) of this section is substituted for the former reference to a

division of the allowance "in a manner as the Board in its discretion
determines to continue as a joint and survivorship pension for the benefit of
the child or children under 18 until every child dies or attains 18" for clarity
and to conform this provision with other similar provisions in this Division II
that apply to the Natural Resources Pension System and the State Police
Retirement System.

29-205. ELECTION OF ALLOWANCE BY SURVIVING SPOUSE — RETIREMENT SYSTEMS
AND LOCAL FIRE AND POLICE TRANSFEREES.

(A) SCOPE OF SECTION.

THIS SECTION APPLIES TO THE SURVIVING SPOUSE OF AN INDIVIDUAL WHO
DIED WHILE EMPLOYED AS A MEMBER OF:

(1) THE CORRECTIONAL OFFICERS' RETIREMENT SYSTEM;

'(2) THE EMPLOYEES' RETIREMENT SYSTEM;
