(I)       AT LEAST 1 YEAR OF ELIGIBILITY SERVICE IN THE
CORRECTIONAL OFFICERS' RETIREMENT SYSTEM, THE EMPLOYEES' PENSION
SYSTEM, THE EMPLOYEES' RETIREMENT SYSTEM, THE LOCAL FIRE AND POLICE
SYSTEM, THE STATE POLICE RETIREMENT SYSTEM, THE TEACHERS' PENSION
SYSTEM, OR THE TEACHERS' RETIREMENT SYSTEM; OR

(II)     MORE THAN 1 YEAR OF ELIGIBILITY SERVICE IN THE NATURAL
RESOURCES PENSION SYSTEM.

(B)      BENEFIT PROHIBITED FOR STATE POLICE IF SPECIAL BENEFIT HAS BEEN
PAID.

A DEATH BENEFIT UNDER THIS SECTION MAY NOT BE PAID FOR THE DEATH OF
A MEMBER OF THE STATE POLICE RETIREMENT SYSTEM IF A SPECIAL DEATH
BENEFIT UNDER § 29-204 OF THIS SUBTITLE IS PAYABLE OR HAS BEEN PAID FOR
THAT DEATH.

(C)      BENEFIT AS GROUP LIFE INSURANCE.

(1)      THIS SUBSECTION DOES NOT APPLY TO MEMBERS OF THE NATURAL
RESOURCES PENSION SYSTEM.

(2)      THE BOARD OF TRUSTEES MAY PROVIDE THE DEATH BENEFIT AS
GROUP LIFE INSURANCE IF THE BOARD OF TRUSTEES FINDS THAT THE
DESIGNATED BENEFICIARIES WOULD RECEIVE A MORE FAVORABLE TAX
TREATMENT OF THE DEATH BENEFIT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 2-417(a) and (b), 3-414(a) and (b), 4-414(a)
and (b), 5-413(a) and (b), 6-411(a), 7-410(a) and (b), 8-408(a), and
10-224(a) and (b).

In subsection (a)(1) of this section, the former word "proper" is deleted as
implied in the word "proof".

Also in subsection (a)(1) of this section, the reference to a member "who died
while employed as a member" is substituted for the former reference to the
death of a member "in service" to reflect that "service" is no longer a defined
term.                               

In subsection (a)(3)(i) of this section, the reference to a member of the State
Police Retirement System having "at least 1" year of eligibility service is
substituted for the reference in former Art. 73B, § 6-411(a)(1)(ii) to a
member having "one through two years" of service to avoid unintended gaps in
the law and to conform with provisions of other State systems.

In subsection (b) of this section, the reference to a special death benefit being
"payable" is added to clarify that it is the eligibility for payments, not the
actual payment of a special death benefit, that precludes payment of an
ordinary death benefit.
