29-114. MULTIPLE DISABILITY ALLOWANCES PROHIBITED.

A MEMBER ENTITLED TO AN ACCIDENTAL DISABILITY RETIREMENT
ALLOWANCE OR A SPECIAL DISABILITY RETIREMENT ALLOWANCE MAY NOT
RECEIVE A RETIREMENT ALLOWANCE FOR ORDINARY DISABILITY.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, §§ 2-404(d), 3-404(d), 4-404(b)(5),
5-404(b)(5), 6-403(d), 7-404(d), 8-402(b)(2), and 10-218(c)(2).

29-115. MEDICAL EXAMINATIONS OF DISABILITY RETIREES.

(A)     IN GENERAL.

IF A DISABILITY RETIREE IS UNDER NORMAL RETIREMENT AGE, THE BOARD
OF TRUSTEES MAY REQUIRE THE DISABILITY RETIREE TO UNDERGO A YEARLY
MEDICAL EXAMINATION.

(B)     EXAMINATION AT RESIDENCE.

(1)      THE RETIREE SHALL BE EXAMINED BY A PHYSICIAN CHOSEN BY
THE BOARD OF TRUSTEES.

(2)      THE EXAMINATION SHALL BE AT THE RETIREE'S RESIDENCE OR
OTHER PLACE AGREED ON BY THE RETIREE AND THE PHYSICIAN CONDUCTING THE
EXAMINATION.

(C)      REFUSAL OF EXAMINATION.

IF A RETIREE WHO IS UNDER NORMAL RETIREMENT AGE REFUSES A MEDICAL
EXAMINATION, THE BOARD OF TRUSTEES MAY STOP PAYMENT OF THE RETIREE'S
ALLOWANCE UNTIL THE RETIREE WITHDRAWS THE REFUSAL:

(D)     REVOCATION OF PENSION RIGHTS.

IF A RETIREE'S REFUSAL OF A MEDICAL EXAMINATION CONTINUES FOR 1
YEAR, THE BOARD OF TRUSTEES MAY REVOKE THE RETIREE'S RIGHTS IN THE
RETIREE'S PENSION.

(E)      MEDICAL AND EARNINGS INFORMATION REQUIRED.

A MEMBER WHO RETIRES ON OR AFTER JULY 1, 1982, AND RECEIVES A
DISABILITY RETIREMENT ALLOWANCE SHALL PROVIDE YEARLY MEDICAL AND
EARNINGS INFORMATION ON REQUEST OF THE BOARD OF TRUSTEES.

(F)      SUSPENSION OF ALLOWANCE.
