29-112. DISABILITY OPTIONS FOR STATE POLICE.

IF THE BOARD OF TRUSTEES APPROVES AN APPLICATION FOR DISABILITY
RETIREMENT FOR A MEMBER OF THE STATE POLICE RETIREMENT SYSTEM THAT
WAS FILED BY THE SUPERINTENDENT OF THE MARYLAND STATE POLICE UNDER §
29-103(C) OF THIS SUBTITLE OR ARTICLE 88B, § 15(B)(16) OF THE CODE, THE MEMBER:

(1)      WITHIN 90 DAYS AFTER APPROVAL, MAY EXERCISE AN OPTION AS
PROVIDED UNDER §§ 21-402 AND 21-403 OF THIS ARTICLE; OR

(2)      SHALL RECEIVE THE BASIC ALLOWANCE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 6-403(b)(3).

In the introductory language of this section, the reference to the filing of an
application "by the Superintendent of the Maryland State Police under §
29-103(c) of this subtitle" is added for clarity.

In item (1) of this section, the phrase "after approval" is added to clarify when
the 90-day period begins.

In item (2) of this section, the defined term "basic allowance" is substituted
for "maximum benefit option" for clarity.

29-113. LIMITATION ON ALLOWANCE FOR PREEXISTING CONDITIONS.

(A) RETIREMENT SYSTEMS.

(1)      THIS SUBSECTION APPLIES TO:

(I)       THE CORRECTIONAL OFFICERS' RETIREMENT SYSTEM;

(II)     THE EMPLOYEES' RETIREMENT SYSTEM;

(III)    THE STATE POLICE RETIREMENT SYSTEM; AND

(IV)    THE TEACHERS' RETIREMENT SYSTEM.

(2)      A MEMBER MAY RECEIVE A DISABILITY RETIREMENT ALLOWANCE
FOR A DISABILITY INCURRED BEFORE ENROLLMENT ONLY TO THE EXTENT THAT
THE DISABILITY WAS AGGRAVATED IN THE ACTUAL PERFORMANCE OF DUTY.
