(II) THE TEACHERS' RETIREMENT SYSTEM.

(2) IF A MEMBER IS UNABLE TO APPLY, THE MEMBER'S STATE OR
COUNTY SUPERINTENDENT MAY COMPLETE AND SUBMIT AN APPLICATION TO THE
BOARD OF TRUSTEES FOR THE MEMBER.

REVISOR'S NOTE: Subsections (a), (b), (c)(2)(i) and (ii), and (d) of this section
are new language derived without substantive change from former Art. 73B,
§§ 2-404(a)(1)(ii) and (b)(1)(i), 3-404(a)(1)(ii) and (b)(1)(i), 4-404(a)(1)(ii)
and (b)(1)(i), 5-404(a)(1)(ii) and (b)(1)(i), 6-403(a)(1)(ii) and (b)(1)(i),
7-404(a)(1)(ii) and (b)(1)(i), 8-402(a)(1)(ii) and (b)(1)(i), and
10-218(a)(1)(ii) and (b)(1)(i) and, as they related to who may submit a
disability retirement application, §§ 2-404(i)(1) and (3), 3-404(i), 4-404(d)(1)
and (3), 5-404(d)(l) and (3), 7-404(i)(l) and (3), 8-402(e)(l) and (3), and
10-218(e)(1) and (2).

Subsection (c)(1) of this section is new language added for clarity.

Subsection (c)(2)(iii), (iv), and (v) and (3) of this section is new language that
repeats the provisions of Art. 88B, § 15(c) and the second clause of (b)(16).

Throughout this section, references to "complet[ing]" an application are
added to state expressly that which formerly only was implied — i.e., that an
application must be completed before it is submitted.

29-104. SAME — LIMITATIONS ON FILING FOR DISABILITY.

(A)     IN GENERAL.

EXCEPT AS PROVIDED IN SUBSECTION (C) OF THIS SECTION AND SUBJECT TO
SUBSECTION (D) OF THIS SECTION, AN APPLICATION FOR DISABILITY RETIREMENT
MUST BE SUBMITTED BEFORE THE DATE MEMBERSHIP ENDS.

(B)      EXCEPTION — EXTENSION OF MEMBERSHIP.
(1) THIS SUBSECTION APPLIES ONLY TO:

(I)       AN APPLICATION FOR AN ORDINARY OR ACCIDENTAL
DISABILITY RETIREMENT ALLOWANCE UNDER THE EMPLOYEES' PENSION SYSTEM
OR THE TEACHERS' PENSION SYSTEM; OR

(II)     AN APPLICATION FOR AN ACCIDENTAL DISABILITY
RETIREMENT ALLOWANCE UNDER THE LOCAL FIRE AND POLICE SYSTEM.
