1994 LAWS OF MARYLAND

SERVICE CREDIT THAT IS PURCHASED UNDER THIS SECTION MAY NOT BE
USED AS SERVICE CREDIT IN ANOTHER RETIREMENT OR PENSION SYSTEM OF THE
STATE OR A POLITICAL SUBDIVISION OF THE STATE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 9-105(i) and the first through fifth sentences

of (j).

In subsection (a) of this section, the former references to "eligib[ility] for
participation in the contributory plan" are deleted as included in the reference
to a "member".

Also in subsection (a) of this section, the reference to periods of service "for
which the member is not otherwise entitled to service credit" is added to
clarify that a member is not entitled to duplicate service credit for the same
period of service.

In subsection (b) of this section, the references to the "Board of Trustees" are
substituted for the former references to the "fund" for accuracy and to
conform to other provisions of this Division II.

Also in subsection (b) of this section, the reference to "complet[ing] a claim
for service credit and fil[ing] it ... on the form that the Board of Trustees
provides" is added to conform to other provisions of this Division II.

Also in subsection (b) of this section, the former references to retirement after
"June 30, 1975" and retirement after "June 30, 1977" are deleted as obsolete.

SUBTITLE 4. BENEFITS.

27-401. ELIGIBILITY FOR RETIREMENT.

A MEMBER OR FORMER MEMBER IS ENTITLED TO A RETIREMENT
ALLOWANCE:

(1)      ON TERMINATION OF SERVICE, IF THE MEMBER IS AT LEAST 60
YEARS OLD;

(2)      ON THE RECOMMENDATION OF THE MEDICAL BOARD, IF THE
MEMBER OR FORMER MEMBER RESIGNS BECAUSE OF DISABILITY;'

(3)     WHEN RETIRED BY ORDER OF THE COURT OF APPEALS; OR

(4)     AT THE AGE OF 60 YEARS, IF THE FORMER MEMBER'S TERMINATION
OF SERVICE OCCURRED EARLIER.
