SUBTITLE 3. SERVICE CREDIT.

27-301. SERVICE CREDIT — TYPES.                                                                 

A MEMBER IS ENTITLED TO' SERVICE CREDIT:

. (1) FOR SERVICE AS A MEMBER;

(2)      REGAINED UNDER § 27-302 OF THIS SUBTITLE BY A MEMBER WHO
REDEPOSITS ACCUMULATED CONTRIBUTIONS PREVIOUSLY WITHDRAWN;

(3)      FOR PRIOR SERVICE AS PROVIDED IN § 27-303 OF THIS SUBTITLE;

(4)      FOR MILITARY SERVICE AS PROVIDED IN TITLE 38 OF THIS ARTICLE;
OR

(5)      PURCHASED UNDER § 27-304 OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language added to conform to similar
provisions in this Division II.

27-302. SAME — REDEPOSIT OF ACCUMULATED CONTRIBUTIONS.

A MEMBER WHO, ON A PRIOR TERMINATION OF SERVICE, WITHDREW
ACCUMULATED CONTRIBUTIONS FROM THE JUDGES' RETIREMENT SYSTEM MAY
RECEIVE SERVICE CREDIT FOR THE PERIOD OF SERVICE DURING THE PREVIOUS
MEMBERSHIP IF, WITHIN 1 YEAR AFTER THE MEMBER IS ELECTED OR CONFIRMED
FOR A NEW TERM, THE MEMBER REDEPOSITS IN A SINGLE PAYMENT THE
WITHDRAWN ACCUMULATED CONTRIBUTIONS PLUS REGULAR INTEREST TO THE
DATE OF REDEPOSIT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 9-105(g).

The word "prior", which modifies "termination of service", is added for
clarity.                                                                                                         

The reference to "member" is substituted for the former reference to "former
judge, ... who thereafter again becomes a judge" for clarity and brevity.

The State Personnel and Pensions Article Review Committee notes, for
consideration by the General Assembly, that there is an ambiguity in this
section as to whether it applies to masters or workers' compensation
commissioners who are neither elected nor confirmed.
