WILLIAM DONALD SCHAEFER, Governor

Ch. 6

(1)      A MEMBER MAY PURCHASE CREDIT FOR ELIGIBILITY SERVICE FOR
PREVIOUS SERVICE IN A POSITION DESCRIBED IN § 23-204(A) OF THIS ARTICLE.

(2)     TO PURCHASE THE SERVICE CREDIT, THE MEMBER MUST PAY, IN A
SINGLE PAYMENT, THE CONTRIBUTIONS, WITH INTEREST, THAT THE BOARD OF
TRUSTEES CONSIDERS APPROPRIATE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 8-301(f) and (g).

In subsection (a)(1) of this section, the reference to "benefits provided under
Subtitle 4 of this title" is deleted as surplusage.

In subsection (a)(1)(i) of this section, the general authorization to purchase
service credit for periods of employment "for which the member would have
been entitled to purchase the service credit under the Employees' Pension
System" is substituted for the former lengthy listing of specific types of
employment, because those types of employment are unlikely to apply to
members of the Natural Resources Pension System.

In subsection (a)(1)(ii) of this section, the reference to eligibility service for
which the member "is not otherwise entitled to service credit" is added to
clarify that a member is not entitled to duplicate service credit for the same
period of employment.

In subsection (a)(2)(i) of this section, the reference to "completing] a claim
for the service credit ... on the form that the Board of Trustees provides" is
added to state expressly that which formerly only was implied — i.e., to file a
claim a member must complete a form provided by the Board of Trustees.

In subsections (a)(2)(ii) and (b)(2) of this section, the references to paying to
"the Board of Trustees" are substituted for the former reference to paying
into "this pension system" and "making ... a payment" to conform to other
similar sections elsewhere in this Division II.

In subsection (a)(3) of this section, the defined term "earnable compensation"
is substituted for the former reference to "compensation per year" for
accuracy.

Defined terms: "Allowance" § 20-101
"Annuity reserve" § 20-101
"Board of Trustees" § 20-101
"Earnable compensation" § 20-101
"Eligibility service" § 20-101
"Employees' Pension System" § 20-101
"Member" § 20-101

"Natural Resources Pension System" § 20-101
"Pension reserve" § 20-101
"Retirement" § 20-101
