26-302. ELIGIBILITY SERVICE — RULES FOR COMPUTATION.

(A)     IN GENERAL.

SUBJECT TO SUBSECTION (B) OF THIS SECTION, A MEMBER IS ENTITLED TO
ELIGIBILITY SERVICE FOR PERIODS OF EMPLOYMENT WHILE A MEMBER OF THE
NATURAL RESOURCES PENSION SYSTEM.

(B)      700-HOUR RULE.

(1)      IF A MEMBER COMPLETES AT LEAST 700 HOURS OF EMPLOYMENT
WHILE A MEMBER IN ANY FISCAL YEAR, THE MEMBER IS ENTITLED TO 1 YEAR OF
ELIGIBILITY SERVICE.

(2)      EXCEPT IN THE FIRST AND LAST FISCAL YEARS, A MEMBER MAY
NOT RECEIVE ANY ELIGIBILITY SERVICE FOR A FISCAL YEAR IN WHICH THE
MEMBER COMPLETES LESS THAN 700 HOURS OF EMPLOYMENT WHILE A MEMBER.

(3)      IN THE FIRST AND LAST FISCAL YEARS, IF A MEMBER COMPLETES
LESS THAN 700 HOURS OF EMPLOYMENT WHILE A MEMBER, THE BOARD OF
TRUSTEES SHALL PRORATE THE ELIGIBILITY SERVICE BASED ON THE NUMBER OF
HOURS WORKED.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 8-301(a).

In subsection (a) of this section, the phrase "[s]ubject to subsection (b) of this
section" is added to clarify that to receive eligibility service, a member must
satisfy the conditions stated in subsection (b).

Also in subsection (a) of this section, the reference to "July 2, 1990" is deleted
as obsolete and unnecessary since an individual could not have been a member
before that date.

In subsection (b) of this section, the references to "employment while a
member" are substituted for the former references to "service" for accuracy
and to reflect that "service" is no longer a defined term.

In subsection (b)(2) and (3) of this section, the word "fiscal" is added to
modify "first and last... years" for clarity and to conform to the reference to a
"fiscal year" in subsection (b)(1) of this section.

In subsection (b)(3) of this section, the reference to the "Board of Trustees" is
added to clarify who has the responsibility to prorate the eligibility service.
