Ch. 6                                       1994 LAWS OF MARYLAND

The only changes are in style.

The State Personnel and Pensions Article Review Committee notes, for the
consideration of the General Assembly, that the second sentence of former
Art. 73B, § 8-103 has been retained in this section though its usefulness is now
questionable. When this section was originally enacted, the law on the Natural
Resources Pension System was cursory; however, the. law on the Natural
Resources Pension System has been expanded in recent years, thus making
this section seem unnecessary. The General Assembly may wish to consider its
repeal.

The first sentence of former Art. 73B, § 8-103 is deleted as unnecessary in
light of § 21-108 of this article.

SUBTITLE 2. MEMBERSHIP.

26-201. MEMBERSHIP IN THE NATURAL RESOURCES PENSION SYSTEM — SCOPE.

THIS SUBTITLE APPLIES ONLY TO AN EMPLOYEE OF THE DEPARTMENT OF
NATURAL RESOURCES COMMISSIONED BY THE SECRETARY OF NATURAL
RESOURCES AS:

(1)      A NATURAL RESOURCES POLICE OFFICER; OR

(2)      A LAW ENFORCEMENT OFFICER, OTHER THAN A NATURAL
RESOURCES POLICE OFFICER.

REVISOR'S NOTE: This section is derived without substantive change from
former Art. 73B, §§ 8-101(e) and 8-201(a).

26-202. SAME — AS A CONDITION OF EMPLOYMENT.

(A)     MEMBERSHIP MANDATORY.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, AN INDIVIDUAL
DESCRIBED IN § 26-201 OF THIS SUBTITLE IS A MEMBER OF THE NATURAL
RESOURCES PENSION SYSTEM AS A CONDITION OF EMPLOYMENT.

(B)    MEMBERSHIP OPTIONAL:

MEMBERSHIP IN THE NATURAL RESOURCES PENSION SYSTEM IS OPTIONAL
FOR AN INDIVIDUAL DESCRIBED IN § 26-201 OF THIS SUBTITLE WHO WAS EMPLOYED
BY THE DEPARTMENT OF NATURAL RESOURCES ON JULY 1, 1990.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 8-201(b) and (c).

In subsections (a) and (b) of this section, the references to "an individual
described in § 26-201" are substituted for the former references to "a law
enforcement officer [in] ... the Department of Natural Resources" for clarity
and consistency.
