23-204. SAME — OPTIONAL MEMBERSHIP.

(A)     IN GENERAL.

MEMBERSHIP IN THE EMPLOYEES' PENSION SYSTEM IS OPTIONAL FOR AN
INDIVIDUAL WHO RECEIVES AN ANNUAL SALARY AND WHO IS:                           

(1)      AN ELECTED OR APPOINTED OFFICIAL;

(2)      AN EMPLOYEE OF THE GOVERNOR'S OFFICE;

(3)      AN EMPLOYEE OF THE SENATE OR HOUSE OF DELEGATES; OR

(4)      A MEMBER OF THE PRINCE GEORGE'S COUNTY BOARD OF LICENSE
COMMISSIONERS.

(B)      EMPLOYEES OF PARTICIPATING GOVERNMENTAL UNITS.

MEMBERSHIP IN THE EMPLOYEES' PENSION SYSTEM IS OPTIONAL FOR THE
EMPLOYEES OF A PARTICIPATING GOVERNMENTAL UNIT WHO ARE EMPLOYED BY
THE PARTICIPATING GOVERNMENTAL UNIT ON THE EFFECTIVE DATE OF
PARTICIPATION IN THE STATE SYSTEMS.

(C)     EMPLOYEES OF DORCHESTER COUNTY.

MEMBERSHIP IN THE EMPLOYEES' PENSION SYSTEM IS OPTIONAL FOR AN
EMPLOYEE OF DORCHESTER COUNTY WHO IS NOT A MEMBER OF THE COUNTY'S
GENERAL PENSION AND RETIREMENT PROGRAM.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, §§ 4-201(c), the first sentence of 4-201(g), as it
related to optional membership in the Employees' Pension System, §
10-103(a)(1) and, as it allowed certain Dorchester County employees to join
the Employees' Pension System, the second sentence of § 4-201(g).

In subsection (a)(4) of this section, the reference to "Alcoholic Beverages",
which formerly modified "License Commissioners" is deleted to reflect the
correct title of the Board.

In subsection (b) of this section, the references to the "participating
governmental unit" are added for clarity.

Also in subsection (b) of this section, the reference to "the effective date of
participation in the State systems" is substituted for the former reference to
"the date the approval is given" to conform to terminology used in Title 31,
Subtitle 1 of this article.
