Throughout this title whenever a provision applies to members of both the
Employees' Retirement System and the Teachers' Retirement System, the term
"member" is substituted for former references to "employees" and "teachers".

Also whenever a provision applies to both systems, the phrase "Employees'
Retirement System or Teachers' Retirement System" is substituted for "retirement
system".                               

Former Art. 73B, §§ 2-206 and 3-206, which related to restoration of membership
in the Employees' Retirement System and the Teachers' Retirement System, are
transferred to the Session Laws, because they appear to be obsolete.

Former Art. 73B, §§ 3-501 through 3-505, and 3-506(a), (b)(2), and (c)(2) and (3)
which related to participation in the Teachers' Retirement. System by employees of
institutions of higher education and libraries, are transferred to the Session Laws,
because they appear to be obsolete.

Former Art. 73B, § 1-507(a), (b), (d), and (e) and the second sentence of (c), which
related to participation in the Employees' Retirement System by former Baltimore City
Jail employees, is transferred to the Session Laws, because it appears to be obsolete.

TITLE 23. EMPLOYEES' AND TEACHERS' PENSION SYSTEMS.

SUBTITLE 1. GENERAL PROVISIONS.

23-101. SCOPE OF TITLE.

THIS TITLE APPLIES ONLY TO:

(1)      THE EMPLOYEES' PENSION SYSTEM; AND

(2)     THE TEACHERS' PENSION SYSTEM.

REVISOR'S NOTE: This section is new language added to clarify the applicability
of this title.

SUBTITLE 2. MEMBERSHIP.

23-201. MEMBERSHIP IN THE EMPLOYEES' PENSION SYSTEM — SCOPE.

(A) APPLICATION.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, §§ 23-202 THROUGH
23-205 OF THIS SUBTITLE APPLY ONLY TO:

(1)      A REGULAR EMPLOYEE WHOSE COMPENSATION IS PROVIDED BY
STATE APPROPRIATION OR PAID FROM STATE FUNDS;

(2)      AN APPOINTED OR ELECTED OFFICIAL OF THE STATE, INCLUDING:
(I) A CLERK OF THE CIRCUIT COURT;
