Ch. 6                                            1994 LAWS OF MARYLAND

In subsection (d)(2)(iv) and (3) of this section, the terms "eligibility service"
and "creditable service" are substituted for the former references to "service"
for clarity and to reflect the application of the terms to each State system.

In subsection (d)(2)(iv) of this section, the phrase "to full force and effect" is
deleted as surplusage.

In subsection (d)(4)(i) of this section, the reference to the pension "during the
previous retirement" is substituted for the former reference to the pension
"prior to restoration" for clarity. Similarly, in subsection (d)(4)(ii) of this
section the reference to the pension "after the previous retirement" is
substituted for the former reference to the pension "after restoration".

In subsection (d)(4)(ii) of this section, the reference to "employment as a
member" is substituted for the former reference to "membership service" to
reflect that "membership service" is no longer a defined term.

22-405. GOVERNOR AND SURVIVING SPOUSE.

(A) ALLOWANCE FOR GOVERNOR IN OFFICE BEFORE JANUARY 17, 1979.

(1)      THIS SUBSECTION APPLIES TO A FORMER GOVERNOR WHO SERVED
AT LEAST ONE FULL TERM OF OFFICE AS GOVERNOR BEFORE JANUARY 17, 1979.

(2)      A FORMER GOVERNOR DESCRIBED IN PARAGRAPH (1) OF THIS
SUBSECTION MAY RETIRE IMMEDIATELY AFTER COMPLETING ONE FULL TERM OF
OFFICE.

(3)      A FORMER GOVERNOR WHO RETIRES UNDER THIS SUBSECTION IS
ENTITLED TO RECEIVE:

(I)       AN ANNUAL RETIREMENT ALLOWANCE OF $12,500; AND

(II)     A COST-OF-LIVING ADJUSTMENT AS PROVIDED BY TITLE 29,
SUBTITLE 4, PART III OF THIS ARTICLE.
