In subsection (a)(3) of this section, the. reference to a "professional ...
employee" is substituted for the former reference to a "librarian" to conform
to subsections (a)(4) arid (b)(3) of this section.

In subsection (b)(2) of this section, the reference to the federal "CETA"
program is deleted as included in the reference to a "federal public service
employment program".

The references in former Art. 73B, §§ 3-504(b), 3-505(b)(1), and 3-506(b)(2),
and the first and second sentences of § 3-501, the first, second, and third
sentences of § 3-502, the first sentence of § 3-504(a), and the first sentence of
§ 3-505(b)(2), to the various boards electing to participate in the Teachers'
Retirement System and to the setting of a date for the participation are
deleted as obsolete since in each instance the boards have elected
participation.

Former Art. 73B, § 3-101(f), which defined the term "public school" is deleted
as unnecessary in light of subsection (a) of this section which describes the
institutions that employ the individuals who are eligible for membership in the
Teachers' Retirement System.

As to former Art. 73B, § 3-101(j)(3), which gave the Board of Trustees
                  authority to determine membership in cases of doubt, see § 22-208 of this

subtitle.

22-206. SAME — CONDITIONS AND RESTRICTIONS.

(A)     MEMBERSHIP AS A CONDITION OF EMPLOYMENT.

EXCEPT AS PROVIDED IN § 22-207 OF THIS SUBTITLE, AN INDIVIDUAL WHO WAS
A MEMBER OF THE TEACHERS' RETIREMENT SYSTEM ON OR BEFORE DECEMBER 31,
1979, BECAME A MEMBER OF THE TEACHERS' RETIREMENT SYSTEM AS A CONDITION
OF EMPLOYMENT.

(B)      MEMBERSHIP RESTRICTED.

EXCEPT AS PROVIDED IN FORMER ARTICLE 73B, § 3-206 OF THE CODE, AN
INDIVIDUAL WHO IS NOT A MEMBER OF THE TEACHERS' RETIREMENT SYSTEM ON
DECEMBER 31, 1979, IS NOT ELIGIBLE FOR MEMBERSHIP IN THE TEACHERS'
RETIREMENT SYSTEM.

REVISOR'S NOTE: Subsection (a) of this section is new language derived without
substantive change from former Art. 73B, § 3-201(a), as it related to
membership as a condition of employment.

Subsection (b) of this section is new language derived without substantive
change from former Art. 73B, § 3-203.

In subsection (a) of this section, the phrase "[e]xcept as provided in § 22-207
of this subtitle" is added for clarity.
