In subsection (a)(1) of this section, the reference to "any current or future
benefit" is substituted for the former list "a pension, ... the return of
contributions ... any optional benefit ... or any other right ..." for brevity.

Similarly, in subsection (a)(2) of this section, the phrase "benefit under this
Division II" is substituted for the former list of possible benefits for brevity.

Also in subsection (a)(2) of this section, the reference to a "court of
competent jurisdiction" is substituted for the former definition of "court" for
brevity and to avoid inadvertently excluding any competent court.

Also in subsection (a)(2) of this section, the former words "only if and to the
extent that" are deleted as unnecessary in light of the word "expressly".

In subsection (b)(2) of this section, the former word "documentation" is
deleted as unnecessary in light of the broad word "information".

In subsection (c) of this section, the reference to a "person" is substituted for
the former reference to a "beneficiary" to avoid inadvertently suggesting
liability for wrongful payment to a "retiree".

21-503. RETIREMENT COUNSELING.

THE BOARD OF TRUSTEES SHALL OFFER COUNSELING ABOUT RETIREMENT
BENEFITS:

(1)      TO THE MEMBERS, FORMER MEMBERS, AND RETIREES OF EACH
STATE SYSTEM; AND

(2)      IF A MEMBER, FORMER MEMBER, OR RETIREE CONSENTS, TO AN
IMMEDIATE FAMILY MEMBER.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 1-505.

The reference to the "Board of Trustees" is added to clarify who has
responsibility for providing the required counseling.

The former reference to "preretirement" counseling is deleted as unnecessary
in light of the reference to counseling about "retirement benefits". The
reference to "former member" is added for clarity since, for the purpose of
providing counseling services, no distinction is made between members or
former members.

The phrase "immediate family member" is substituted for "spouse or members
of the immediate family" for brevity since the spouse would be considered part
of the immediate family.
