AN ACT concerning

New Tidal Fish License - Two-Year Waiting Period - Exemption

FOR the purpose of exempting certain persons from the two-year waiting period for a
new tidal fish license; making a certain technical correction; and making this Act an
emergency measure.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

4-703.

(c) (1) Before the Department may issue to a person a new tidal fish license,
the person [must] SHALL:

[(1)](I) Register with the Department on a form provided by the
Department at least 2 years before the year of license issuance;

[(2)] (II) Supply verifiable evidence of any federal license that is issued in
the applicant's name by the U.S. Coast Guard to operate a vessel carrying passengers for
hire; and

[(3)] (III) Pay all applicable tidal fish license fees set under § 4-701 of this
subtitle at the time of registration.

(2) THE REQUIREMENT OF PARAGRAPH (1)(I) OF THIS SUBSECTION
DOES NOT APPLY TO A PERSON WHO HAS RECEIVED A PARDON AFTER BEING
INCARCERATED FOR A CRIMINAL OFFENSE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety, has
been passed by a yea and nay vote supported by three-fifths of all the members elected to
each of the two Houses of the General Assembly, and shall take effect from the date it is
enacted.
