WILLIAM DONALD SCHAEFER, Governor                       H.B. 870

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 870.

This bill would authorize the Prince George's County Board of Education to negotiate
with the employee collective bargaining organization for the imposition of a fee, not to
exceed the organization's annual dues, to be charged to nonmembers for negotiation
services provided by the employee organization.

Senate Bill 72, which was passed by the General Assembly and signed by me on May 26,
1994, accomplishes the same purpose. Therefore, it is not necessary for me to sign House
Bill 870.

AN ACT concerning

Prince George's County - Public School Employees - Service or Representation Fee

PG 402-94

FOR the purpose of authorizing the Prince George's County Board of Education to
negotiate with certain employee organizations for the imposition of a fee to be
charged to certain employees for negotiation services provided by the employee
organization; and generally relating to public school employees in Prince George's
County.

BY repealing and reenacting, with amendments,
Article - Education
Section 6-407(c)
Annotated Code of Maryland
(1992 Replacement Volume and 1993 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

6-407.

(c) (1) In Montgomery [County] AND PRINCE GEORGE'S COUNTIES and
Baltimore City, the public school employer may negotiate with the employee organization
designated as the exclusive representative for the public school employees in a unit, a
reasonable service or representation fee, to be charged nonmembers for representing
them in negotiations, contract administration, including grievances, and other activities as
are required under subsection (b) of this section.
