Developmental Disabilities - Community-Based Services - Funding

FOR the purpose of requiring the Developmental Disabilities Administration to establish
and adhere to certain practices related to its funding system for the distribution of
State funds to private providers for the provision of community-based services to
individuals with developmental disability; requiring the Administration to notify
providers of the billing rate to be paid to providers within a certain time; specifying
that a provider may request an administrative resolution of the billing rate for a
certain purpose; requiring the Administration to pay providers in accordance with a
certain payment schedule under certain circumstances; providing for a certain
deviation in funding to certain providers under certain circumstances; providing for
the amount of a reduction under certain circumstances; requiring the
Administration to place sufficient funds in a certain account to fulfill its financial
obligations to providers; and generally relating to requiring the Developmental
Disabilities Administration to develop and implement a certain funding system for
the provision of community-based services by private providers to individuals with
developmental disability.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

7-306.1.

(A)     THE ADMINISTRATION SHALL DEVELOP AND IMPLEMENT A FUNDING
SYSTEM FOR THE DISTRIBUTION OF STATE FUNDS TO PRIVATE PROVIDERS THAT
ARE UNDER CONTRACT WITH THE DEVELOPMENTAL DISABILITIES
ADMINISTRATION TO PROVIDE COMMUNITY-BASED SERVICES TO INDIVIDUALS
WITH DEVELOPMENTAL DISABILITIES IN ACCORDANCE WITH THE STATE PLAN.

(B)     (1) UNDER THE FUNDING SYSTEM DEVELOPED UNDER SUBSECTION (A)
OF THIS SECTION, THE ADMINISTRATION SHALL NOTIFY EACH PRIVATE PROVIDER
AT LEAST 30 DAYS BEFORE THE BEGINNING OF THE FISCAL YEAR OF THE BILLING
RATE OR AMOUNT OF FUNDS TO BE PAID TO THE PROVIDER FOR THE PROVISION OF
COMMUNITY-BASED SERVICES TO AN INDIVIDUAL WITH DEVELOPMENTAL
DISABILITY OR A GROUP OF INDIVIDUALS WITH DEVELOPMENTAL DISABILITY FOR
THE COMING FISCAL YEAR.

(2) (I) A PRIVATE PROVIDER MAY REQUEST AN ADMINISTRATIVE
RESOLUTION OF A BILLING RATE SET UNDER PARAGRAPH (1) OF THIS SUBSECTION.
