H.B. 283                                                 VETOES

1. The room of a registered guest in a hotel, motel, or hospice;
or

2. The property of a volunteer fire company.

(ii) The following are exempt from [paragraph] PARAGRAPHS (1)
AND (2) of this subsection if they have been in existence for a minimum of 3 years:

1.       A bona fide catering establishment;

2.       A community or civic association;

3.       A swim club;

4.       A bona fide social, civic, nonprofit, charitable, fraternal,
patriotic, educational, or public service organization; or

5.       A bona fide religious institution.

[(3)] (4) The Worcester County Board of License Commissioners shall
adopt uniform [rules] REGULATIONS for the administration of [exceptions specified in
paragraph (2) of] THE PROVISIONS OF this subsection.

[(4)] (5) Any owner, operator, manager, or employee of premises or places
subject to the prohibitions of this subsection who knowingly permits consumption in
violation of this subsection is guilty of a misdemeanor and, on conviction, shall be fined
not more than $10,000.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 283.

House Bill 283 would prohibit an agency of State government from electronically
reproducing a regulation from the Code of Maryland Regulations (COMAR), the
permanent supplements to the Code of Maryland Regulations, or the Maryland Register,
without the written permission of the Joint Committee on Administrative, Executive, and
Legislative Review (AELR).

Current law (Section 10-115(a) of the State Government Article) prohibits State agencies
from resetting or reprinting regulations from COMAR or its supplements, or from the
Maryland Register. I am advised by the Attorney General (in House Bill 283 review letter
of April 25, 1994) that the existing prohibition found in Section 10-115 (a) constitutes a
