and the proceeds of the loan shall be expended for the purposes provided in this Act. If
this evidence is not presented by June 1, [1994] 1996, the proceeds of the loan shall be
applied to the purposes authorized in § 8-129 of the State Finance and Procurement
Article.

(6) Prior to the payment of any funds under the provisions of this Act for the
purposes set forth in Section 1(3) above, the Treatment and Learning Centers, Inc. shall
demonstrate to the Board of Public Works that the Treatment and Learning Centers, Inc.
has adopted a policy to accept all patients on a first come, first served basis to assure
residents of all subdivisions in the State equal access to use of the facility.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1994.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 105.

This bill would authorize funds as a grant to the Board of Directors of Montgomery
Hospice Society, Inc. for the planning, design, and construction of a residential hospice
facility in Montgomery County, and permit the use of in kind contributions and
expenditures made prior to the effective date of the Act to be used as part of the
matching fund.

Senate Bill 391, which was passed by the General Assembly and signed by me on May 2,
1994, accomplishes the same purpose. Therefore, it is not necessary for me to sign House
Bill 105.
