(2) A county board is not required to order a reinspection of any public
school under its jurisdiction for asbestos containing material if the public school was
inspected before July 1, 1986 for all asbestos containing material, including friable
asbestos and nonfriable asbestos.

(c)     (1) A county board may authorize the following persons to inspect a public
school for asbestos containing material:

(i) School personnel who possess inspection credentials that are
approved by the department, in consultation with the Department of Health and Mental
Hygiene; or

(ii) A representative of a business entity that possesses inspection
credentials that are approved by the Department, in consultation with the Department of
Health and Mental Hygiene.

(2) The inspection shall be conducted in accordance with procedures
established by the Department of Health and Mental Hygiene, complying as a minimum,
with all appropriate federal regulations.

(d)     (1)] A county board shall keep a copy of each inspection report
CONCERNING THE ASBESTOS INSPECTION of [a] EACH public school in the county.

[(2)](B) Each public school shall keep for review during regular school
hours upon request by any member of the public a copy of the inspection report
CONCERNING THE ASBESTOS INSPECTION at the public school.

EXPLANATION: Section 7-418 of the Education Article requires that each public
school in the State be inspected for asbestos. The inspections have been
completed, so staff recommends the repeal of subsections (a) through (c) of
this section. Section 7-418(d), requiring retention of a report and availability
of the report at each school, is a continuing requirement.

21-101.

(a)     There is a county advisory council on vocational-technical education in each
county.

(b)     (1) [In a county that has an average daily public school attendance of less
than 7,000, the council shall have at least 10 members.

(2) In a county that has an average daily public school attendance of at least
7,000, the council shall have at least 15 members.

(3)] THE COUNTY BOARD SHALL DETERMINE THE NUMBER OF
MEMBERS ON THE COUNCIL.

(2) [In addition to the membership provided in this subsection,] THE
COUNCILS MAY INCLUDE educators and administrators in the field of education [may
serve,] AS ex officio, [as] nonvoting members of the councils.
