S.B. 382

VETOES

Dear Mr. President:                                                                             

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 382.

This bill would provide that the juvenile courts do not have jurisdiction over juveniles who
have a previous criminal (adult) conviction, are over 14 years old and charged with certain
sexual offenses or crimes punishable by death or life imprisonment, or are over 16 years
old and charged with certain violent crimes.

House Bill 1122, which was passed by the General Assembly and signed by me on May 26,
1994, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 382.

AN ACT concerning

Juvenile Causes - Jurisdiction

FOR the purpose of providing that a court may not transfer a case to the juvenile court if
the child was previously convicted of certain crimes or was previously convict
ed of a
crime aft
er the juvenile court waived jurisdiction; providing that the juvenile court
does not hav
e jurisdiction over a child who has previously been convicted of certain
crimes or a child older than 14 who is alleged to have done an act in violation of
certain s
exual offenses statutes; narrowing the jurisdiction of the juvenile court to
prohibit the court from exercising original jurisdiction over cases involving a child of
a certain age who is charged with certain types of crim
es or cases involving a child
who was previously convicted of certain types of crimes; permitting a court to
transfer such a case back to the juvenile court under certain circumstances;
terminating the juvenile court's jurisdiction under certain circumstances;
and
generally relating to the jurisdiction of the juvenile court
narrowing the original
jurisdiction of the juvenile court to preclude the juvenile court from exercising jurisdiction
over a child of at least a certain age who is charged with certain crimes; specifying the
types of cases a court may transfer to the juvenile court; making stylistic changes; and
generally relating to juvenile court jurisdiction.
