SECTION 5. AND BE IT FURTHER ENACTED, That, except as provided in
Section 3 of this Act, this Act shall take effect October 1, 1994.

Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland Constitution; I have today
vetoed Senate Bill 298.
This Administration bill would require the Maryland State Police to establish a statewide
DNA data base system.
House Bill 410, which was passed by the General Assembly and signed by me on May 26,
1994, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 298.

AN ACT concerning
State Police - Statewide DNA Data Base System and Repository
FOR the purpose of creating a statewide DNA data base system and repository within the
Crime Laboratory Division of the Maryland State Police; establishing the system
and repository as the State's central location for all DNA samples and testing
information collected under this Act; requiring the Director of the Crime
Laboratory to adopt consult with the Superintendent of the Maryland State Police on
the adoption of certain rules and regulations; requiring the Superintendent to adopt
certain regulations under certain circumstances; specifying that any regulations
adopted contain certain restrictions and conditions; specifying that certain persons
convicted of certain crimes shall provide a DNA sample under certain
circumstances; establishing the procedures to be followed in the taking of a DNA
sample; specifying that only certain persons may collect a DNA sample; providing
for immunity from civil liability for certain persons who take DNA samples under
certain circumstances; specifying the purposes for which DNA samples shall be
tested; providing for the storage of DNA samples and DNA identification
characteristics; providing for the security of DNA samples and DNA typing results
stored in the repository and data base system; establishing certain standards that
certain laboratories shall meet for inclusion in the statewide DNA data base system;
requiring certain testing of the Crime Laboratory and analysts performing DNA analyses
