(1)      the sending track;

(2)      the receiving track;

(3)      the organization that represents a majority of the owners and trainers
who race horses at the sending track during the race meeting when the intertrack betting
is to occur; and

(4)      the organization that represents a majority of the owners and trainers
who held races at the most recent race meeting of the receiving track,

(d)     (1) Laurel Race Course may be a receiving track only if live racing was held
there in the previous calendar year on at least 75% of the racing days available to it.

(2)      Pimlico Race Course may be a receiving track only if at least 90 days of
live racing were held there in the previous calendar year.

(3)     The Commission may waive a requirement of this subsection if the
receiving track could not meet the requirement because of:

(i) an act of God; or

(ii) what the Commission finds to be an emergency.

(e)     All intertrack betting shall be done at a receiving track.

(f)      A sending track shall transmit to a receiving track, in the way that the
Commission approves, a live simulcast of each race on which intertrack betting is
authorized under this section.]

(A) IN THIS SECTION, "STATE FAIR SOCIETY" MEANS THE MARYLAND STATE
FAIR AND AGRICULTURAL SOCIETY, INC.

[(a)](B) (4) This section applies only to intertrack betting in which:

(i) (1) the sending track [is a mile thoroughbred track or a harness
track and] is equipped to transmit simulcast races AND IS:

1. (I) A MILE THOROUGHBRED TRACK;

2. (II) A HARNESS TRACK; OR

3. (III) A TRACK WHERE RACING IS CONDUCTED BY THE
STATE FAIR SOCIETY; and

(ii) (2) the receiving track [is [a harness track or Laurel Race
Course and]:

1. is (I) equipped to receive simulcast races and hold
intertrack betting on those races; AND

2. FOR HARNESS RACING, IS A TRACK OTHER THAN PIMLICO
RACE COURSE.
