Ch. 750

In this section, "Council" means the Procurement Advisory Council.
There is a Procurement Advisory Council.

(1)      The Council consists of the following [7] NINE members:

[(1)](I) the State Treasurer;

[(2)](II) the Chancellor of the University of Maryland System;

[(3)] (III) the Secretary of Budget and Fiscal Planning;

[(4)] (IV) the Secretary of General Services;

[(5)](V) the Secretary of Transportation;

[(6)] (VI) the Secretary of the Board; [and]

(VII) A REPRESENTATIVE OF LOCAL GOVERNMENT WHO HAS
EXPERTISE IN LOCAL PROCUREMENT MATTERS, APPOINTED BY THE GOVERNOR
WITH THE ADVICE AND CONSENT OF THE SENATE; AND

[(7)] (VIII) [a member] TWO MEMBERS of the general public, AT LEAST
ONE OF WHOM HAS EXPERTISE IN STATE PROCUREMENT MATTERS, APPOINTED BY
THE GOVERNOR WITH THE ADVICE AND CONSENT OF THE SENATE .

(2)      (I) IF THE STATE TREASURER IS UNABLE TO ATTEND A MEETING
OF THE PROCUREMENT ADVISORY COUNCIL, THE TREASURER MAY DESIGNATE
THE DEPUTY TREASURER TO ATTEND THE MEETING.

(II) IF A MEMBER OF THE COUNCIL LISTED IN PARAGRAPH (1) (II)
THROUGH (V) OF THIS SUBSECTION IS UNABLE TO ATTEND A MEETING OF THE
PROCUREMENT ADVISORY COUNCIL, THE MEMBER MAY DESIGNATE THE CHIEF
PROCUREMENT OFFICER OF THE AGENCY TO ATTEND THE MEETING.

(d)     The Secretary of the Board is Chairman of the Council.

(e)      The Council shall meet at least [once a] QUARTERLY EACH year.

(f)      The PROCUREMENT ADVISOR IS THE PRINCIPAL STAFF OF THE COUNCIL
AND THE Council shall have [the] ANY ADDITIONAL staff that the Board authorizes in
accordance with the State budget.

(g)      [(1) The Council may study and analyze matters within the jurisdiction of the
Board.

(2) As directed by the Board, the Council shall discuss and advise the Board
on:

(i) problems in the procurement process; and

(ii) recommendations for improvement of the process.] THE COUNCIL
