Ch. 706                                    1994 LAWS OF MARYLAND

(b)     The Board of Trustees shall:

(1)     stop retirement allowance payments after the last day of the month
before the retiree returns to active employment;

(2)     restore previous creditable service and eligibility service to the account
of the member; and

(3)     credit the member with creditable service and eligibility service
performed beginning the date of reemployment.

(c)     If the member later retires or dies while employed by a participating
employer, the Board of Trustees shall reduce the member's annuity reserve and pension
reserve by the amount of payments made to the member during the member's earlier
retirement unless the member had reimbursed the State system for the payments.

(D) IF A MEMBER WHO HAS BEEN RESTORED TO MEMBERSHIP UNDER THIS
SECTION ELECTS TO TRANSFER TO A PENSION SYSTEM UNDER § 22-212 OF THIS
TITLE, THE BOARD OF TRUSTEES SHALL REDUCE THE MEMBER'S TRANSFER
REFUND BY THE AMOUNT OF THE REDUCTION IN RESERVES THAT WOULD HAVE
BEEN MADE UNDER SUBSECTION (C) OF THIS SECTION.                                           

SECTION 3. AND BE IT FURTHER ENACTED, That Section 1 of this Act shall
take effect June 1, 1994 and shall remain in effect, until October 1, 1994.                

SECTION 4. AND BE IT FURTHER ENACTED, That Section 2 of this Act shall
take effect October 1, 1994.

AN ACT concerning

Estates and Trusts - Probate Court - Determining Questions of Title

FOR the purpose of authorizing a probate court to determine questions of title to certain
personal property for the purpose of determining what personal property is
includable in an estate; making stylistic changes; providing for the application of
this Act; and generally relating to the jurisdiction of probate courts.
