. SECTION 4. 5. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

(House Bill 288)

AN ACT concerning

Retirement and Pension Systems - Reemployment of Retirees as Elected Officials or

Constitutional Officers for a County

FOR the purpose of exempting certain retirees of the Employees' Retirement System, the
Teachers' Retirement System, the Employees' Pension System, or the Teachers'
Pension System from certain restrictions on reemployment under certain
circumstances; providing for the construction and application of this Act; and
generally relating to retirement benefits for certain reemployed retirees of the State
retirement and pension systems.

BY repealing and reenacting, with amendments,

Section 22-407 and 23-408
Annotated Code of Maryland

(As enacted by Chapter__ (S.B. 1) of the Acts of the General Assembly of 1994)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Personnel and Pensions

22-407.                                                                                                                         

(a) THIS SECTION DOES NOT APPLY TO A RETIREE WHO IS SERVING IN AN
ELECTED POSITION AS AN OFFICIAL OF A PARTICIPATING GOVERNMENTAL UNIT OR
AS A CONSTITUTIONAL OFFICER FOR A COUNTY THAT IS A PARTICIPATING
GOVERNMENTAL UNIT.

(B) If a retiree who is receiving a service retirement allowance is reemployed in a
permanent position with a participating employer, the retiree's retirement ends and the
individual shall be restored to membership in the State retirement system appropriate for
the position.

[(b)](C) The Board of Trustees shall:

(1) stop retirement allowance payments after the last day of the month
before the retiree returns to active employment;
