1994 LAWS OF MARYLAND

(B) (2) THIS SECTION SUBSECTION DOES NOT APPLY TO A COIN MACHINE
OPERATOR OR LOCKSMITH WHO, IN THE ORDINARY COURSE OF BUSINESS,
POSSESSES A LOCK PICK DEVICE.

(C) (3) A PERSON WHO VIOLATES THIS SECTION SUBSECTION IS GUILTY OF
A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE OF NOT MORE THAN
$1,000 OR IMPRISONMENT FOR A TERM OF NOT MORE THAN 90 DAYS OR BOTH.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article 27 - Crimes and Punishments

35.

(a) (1) A person may not possess burglar's tools with the intent to use or permit
the use of the tools in the commission of any crime involving the breaking and entering of
a motor vehicle.

[(b)](2) A person may not be in or on the motor vehicle of another with the
intent to commit theft of the vehicle Or property that is within the vehicle.

[(c)](3) A person who violates this [section] SUBSECTION is guilty of a
misdemeanor, shall be deemed a rogue and vagabond, and on conviction is subject to
imprisonment for not more than 3 years.

(B) (1) A PERSON MAY NOT POSSESS A DEVICE, COMMONLY KNOWN AS A
LOCK PICK, THAT IS MANUFACTURED OR DESIGNED TO DEFEAT A LOCK ON A COIN
MACHINE, AS DEFINED IN § 340(A) OF THIS ARTICLE, WITH THE INTENT TO DEFEAT A
LOCK ON A COIN MACHINE.

(2)      THIS SUBSECTION DOES NOT APPLY TO A COIN MACHINE OPERATOR
OR LOCKSMITH WHO. IN THE ORDINARY COURSE OF BUSINESS. POSSESSES A LOCK
PICK DEVICE.

(3)      A PERSON WHO VIOLATES THIS SUBSECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE OF NOT MORE THAN
$1,000 OR IMPRISONMENT FOR A TERM OF NOT MORE THAN 90 DAYS OR BOTH.

SECTION 3. BE IT FURTHER ENACTED, That if Chapter ___ (H.B. 471/S.B.

322) of the Acts of the General Assembly of 1994 becomes effective, Section 1 of this Act
shall be null and void without the necessity of further action by the General Assembly,

and if Chapter____does not become effective, Section 2 of this Act shall be null and void

without the necessity of further action by the General Assembly.

SECTION 2. 4. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.
