AN ACT concerning

Children, Youth, and Families

FOR the purpose of establishing the Subcabinet for Children, Youth, and Families
Resource Fund; defining certain terms; providing that certain funds shall be
credited to the Fund; providing for the use of the Fund; requiring certain moneys in
the Fund to revert to the General Fund under certain conditions; requiring the
Subcabinet to submit a certain report; and generally relating to the Subcabinet for
Children, Youth, and Families Resource Fund.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 49D - Office for Children, Youth, and Families

4.2.

(A)     (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(2)      "LOCAL PLANNING ENTITY" MEANS THE ENTITY ESTABLISHED OR
DESIGNATED IN ACCORDANCE WITH § 11 OF THIS ARTICLE.

(3)      "LOCAL PLANNING ENTITY GRANT AGREEMENT" MEANS THE
AGREEMENT EXECUTED BETWEEN THE STATE AND LOCAL PLANNING ENTITY FOR
THE PROVISION OF SERVICES FOR CHILDREN AND FAMILIES IN ACCORDANCE WITH
THE PLANS DEVELOPED UNDER §§ 19.1 AND 38 OF THIS ARTICLE.

(4)      "INCENTIVES" MEANS THE MONEYS:

(I)       AVAILABLE FROM THE REDUCTION OF COSTS OF OUT OF
HOME PLACEMENTS; AND

(II)     PAID IN ACCORDANCE WITH LOCAL PLANNING ENTITY GRANT
AGREEMENTS.

(B)     THERE IS A SUBCABINET FOR CHILDREN, YOUTH, AND FAMILIES
RESOURCE FUND.
