5-102.
THE DEPARTMENT MAY, IN CONSULTATION WITH THE DEPARTMENT OF
PUBLIC SAFETY AND CORRECTIONAL SERVICES, ESTABLISH THE MARYLAND YOUTH
PROGRAM IN ACCORDANCE WITH THE PROVISIONS OF THIS SUBTITLE.
5-103.
THE PRIMARY PURPOSE OF THE PROGRAM SHALL BE TO PROVIDE CUSTODY,
CARE, INDUSTRIAL TRAINING, VOCATIONAL EDUCATION, AND OTHER TRAINING,
GUIDANCE, AND TREATMENT TO:
(1) CHILDREN WHO ARE TOO MATURE TO BENEFIT FROM ANOTHER
FACILITY OR PROGRAM OF THE DEPARTMENT FOR JUVENILE OFFENDERS; AND
(2) YOUTHFUL OFFENDERS WHO ARE TOO IMMATURE TO BENEFIT
FROM A FACILITY OR PROGRAM OF THE DIVISION OF CORRECTION OR A LOCAL
CORRECTIONAL FACILITY.
5-104.
(A) A DIRECTOR, APPOINTED BY THE SECRETARY, SHALL BE THE CHIEF
ADMINISTRATIVE OFFICER OF THE PROGRAM.
(B) THE DIRECTOR SHALL SERVE AT THE PLEASURE OF THE SECRETARY
AND SHALL RECEIVE THE SALARY PROVIDED IN THE STATE BUDGET.
5-105.
(A) AN INDIVIDUAL IS ELIGIBLE FOR ADMISSION TO THE PROGRAM IF:
(1) THE INDIVIDUAL IS ADJUDICATED DELINQUENT AND THE
JUVENILE COURT ISSUES A DISPOSITION ORDER UNDER § 3-820A OF THE COURTS
AND JUDICIAL PROCEEDINGS ARTICLE COMMITTING THE INDIVIDUAL TO THE
CUSTODY OF THE DEPARTMENT WITH A RECOMMENDATION TO THE DEPARTMENT
FOR ADMISSION TO THE PROGRAM; OR
(2) (I) THE INDIVIDUAL IS UNDER THE AGE OF 21 YEARS, CONVICTED
OF A CRIME, AND SENTENCED TO THE DIVISION OF CORRECTION OR A LOCAL
CORRECTIONAL FACILITY; AND
(II) THE DIVISION OF CORRECTION OR THE LOCAL
CORRECTIONAL FACILITY RECOMMENDS ADMISSION OF THE INDIVIDUAL TO THE
PROGRAM.
(B) AN INDIVIDUAL FOR WHOM THERE IS A RECOMMENDATION FOR
ADMISSION TO THE PROGRAM MAY BE ADMITTED TO THE PROGRAM ONLY IF
ADMISSION OF THE INDIVIDUAL IS APPROVED BY THE DIRECTOR.
