(5) All licenses and franchises shall remain in effect and valid until they expire by
their own terms or are modified or terminated by the appropriate Prince George's County
governmental authority.
(6) If any personal property that belongs to Montgomery County is in the part of
the City of Takoma Park formerly located in Montgomery County, Montgomery County
may remove the personal property before the effective date of the boundary alteration.
Whatever personal property is not removed shall become the property of Prince George's
County. Real property shall become the property of Prince George's County.
(7) After the effective date of the boundary alteration, a portion of Montgomery
County may not be annexed to any municipality that is not located wholly within the
boundaries of Montgomery County.
(8) Any child who resides in that portion of the City of Takoma Park that was
formerly in Montgomery County may continue to bo enrolled in the school system of
Montgomery County without payment of tuition, notwithstanding any change in the
county boundary line that results from this Act.
(9) (8) Any person registered to be a voter in that portion of the City of Takoma
Park in Montgomery County as of the date immediately preceding the effective date of
the boundary alteration thereafter shall be deemed to be a registered voter in Prince
George's County.
SECTION 6. AND BE IT FURTHER ENACTED, That any child enrolled in a
county public school in the school year prior to the date of unification of Takoma Park
shall be entitled to remain enrolled in the same school after unification into the other
county, and in no instance may the parents of the child be required to pay tuition.
On or before May 1, 1996, the Mayor and Council of Takoma Park and the County
Executive, County Council, and Board of Education of Montgomery County, or their
designees, shall meet and confer to determine, if the City of Takoma Park is unified into
Montgomery County, the amount of reimbursement that the City of Takoma Park and the
Board of Education of Montgomery County shall pay to the Board of Education of Prince
George's County for the education of those children who after unification remain
enrolled in the public schools of Prince George's County. The total amount paid to the
Board of Education of Prince George's County shall be based on the formula used for
calculating nonresident tuition as determined by the Board of Education of Prince
George's County for the 1994-1995 school year.
SECTION 6. 7. AND BE IT FURTHER ENACTED, That the County Councils
and the County Executives of Montgomery County and Prince George's County shall do
all those things necessary and proper to implement this Act.
SECTION 7. 8. AND BE IT FURTHER ENACTED, That the effective date of any
boundary alteration under this Act shall be July 1, 1996 1997.
SECTION 8. 9. AND BE IT FURTHER ENACTED, That, subject to the
provisions of Section 2 of this Act and for the sole purpose of providing for the referenda
required by this Act, this Act shall take effect July 1, 1994.
