(B) A PROVISION IN AN EXECUTORY CONTRACT BETWEEN A CONTRACTOR
AND A SUBCONTRACTOR THAT IS RELATED TO CONSTRUCTION, ALTERATION, OR
REPAIR OF A BUILDING, STRUCTURE, OR IMPROVEMENT AND THAT CONDITIONS
PAYMENT TO THE SUBCONTRACTOR ON RECEIPT BY THE CONTRACTOR OF
PAYMENT FROM THE OWNER OR ANY OTHER THIRD PARTY MAY NOT ABROGATE
OR WAIVE THE RIGHT OF THE SUBCONTRACTOR TO:
(1) CLAIM A MECHANIC'S LIEN; OR
(2) SUE ON A CONTRACTOR'S BOND.
(b) (C) Any [waiver] provision of a contract made in violation of this section is
void AS AGAINST THE PUBLIC POLICY OF THIS STATE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act does not apply
to any contract entered into prior to October 1, 1994.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

AN ACT concerning
State Personnel - Leave for Public Health Reasons
FOR the purpose of allowing paid leave and medical costs for certain employees who test
positive to tuberculin tests performed at the direction of the employee's appointing
authority; specifying the maximum amount of leave that may be granted under this Act
to certain employees for public health reasons; and clarifying that certain employees may
use certain other types of leave under certain circumstances.
