(House Bill 885)

AN ACT concerning

Human Relations Commission - Election for Judicial Action

FOR the purpose of altering certain authority of the Human Relations Commission to
make an election for certain judicial action in certain housing discrimination cases;
authorizing certain parties to elect a certain judicial remedy instead of a certain
administrative remedy; requiring a certain election to be made within a certain time;
requiring a person who makes a certain election to give a certain notice; and
generally relating to the Human Relations Commission and certain elections for
judicial action.

Article 49B - Human Relations Commission
Section 32(a) and (l)(1)
Annotated Code of Maryland

BY repealing and reenacting, without amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 49B - Human Relations Commission

32.

(a) (1) When a charge is filed under § 30 of this subtitle, [the Commission may
choose to have the claims asserted in the charge decided in a civil action under subsection
(1) of this section instead of a hearing under subsection (b) of this section if:

(i) A] A complainant, RESPONDENT, or aggrieved person on whose
behalf the complaint was filed [elects] MAY ELECT to have the claims asserted in the
charge decided in a civil action under subsection [(k)] (L) of this section[; and]
INSTEAD OF A HEARING UNDER SUBSECTION (B) OF THIS SECTION.

[(ii) The Commission determines that court action is warranted in the
case.]

(2) [The complainant or aggrieved person must notify the Commission of
their election of court action not later than 20 days after the receipt by the person of
service under § 30 of this subtitle.] THE ELECTION AUTHORIZED UNDER PARAGRAPH
