WILLIAM DONALD SCHAEFER, Governor

Ch. 608

FOR the purpose of prohibiting a lobbyist who is required to register under a specified
provision of the Prince George's County Code, or a person acting on behalf of the
lobbyist, from engaging in certain activities relating to fund-raising on behalf of a
member of the County Council of Prince George's County, the County Executive of
Prince George's County, or a candidate seeking election to the Council or as County
Executive; prohibiting a lobbyist who is required to register under a specified
provision of the Montgomery County Code, or a person acting on behalf of the
lobbyist, from engaging in certain activities relating to fund-raising on behalf of a
member of the County Council of Montgomery County, the County Executive of
Montgomery County, or a candidate seeking election to the Council or as County
Executive; providing that this Act may not be construed in a certain manner;
defining certain terms; providing for certain penalties; providing for the application of
certain provisions of this Act;
and generally relating to restriction of fund-raising
activities by lobbyists in Prince George's County and Montgomery County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 40A - Maryland Public Ethics Law

6-304.

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(2)      "CANDIDATE" HAS THE MEANING STATED IN ARTICLE 33, § 1-1(A) OF
THE CODE, BUT ONLY AS IT APPLIES TO A CANDIDATE SEEKING ELECTION AS A
LOCAL OFFICIAL.

(3)      "CONTRIBUTION" AND "POLITICAL COMMITTEE" HAVE THE
MEANINGS STATED IN ARTICLE 33, § 1-1(A) OF THE CODE.

(4)      "LOBBYIST" MEANS A PERSON REQUIRED TO REGISTER UNDER §
2-295 OF THE PRINCE GEORGE'S COUNTY CODE OR § 19A-21 OF THE MONTGOMERY
COUNTY CODE.

(5)      "LOCAL OFFICIAL" MEANS:

(I) A MEMBER OF THE COUNTY COUNCIL OF PRINCE GEORGE'S
COUNTY OR THE COUNTY EXECUTIVE OF PRINCE GEORGE'S COUNTY; OR

(II) A MEMBER OF THE COUNTY COUNCIL OF MONTGOMERY
COUNTY OR THE COUNTY EXECUTIVE OF MONTGOMERY COUNTY.
