(c)     (1) This section does not require a hotel or restaurant which presently holds
a Class B beer, wine and liquor license to obtain a Class H license if catering is, or has
been, a part of the service provided by the hotel or restaurant.

(2) If a holder of an existing hotel or restaurant Class B beer, wine and
liquor license provides catering services on or off the licensed premises, the holder is
subject to the requirements of subsection (b)(3) of this section.

(d)     A beer, wine and liquor license may be issued to a caterer who has entered
into an exclusive lease with a volunteer fire company for a banquet facility owned by that
volunteer fire company.

(A) (1) THIS SECTION APPLIES ONLY IN WICOMICO COUNTY.

(2) IN THIS SECTION, "BOARD" MEANS THE BOARD OF LICENSE
COMMISSIONERS.

(b) The annual LICENSE fee [for the license] is $500.

[(a)](C) (1) [In Wicomico County, the board of license commissioners] THE
BOARD may issue a caterer's license.

(2) If a caterer's license is issued, it shall only be issued to a holder of a
Class B restaurant or hotel (on-sale) beer, wine and liquor license [in Wicomico
County].

[(c)](D) A caterer's license issued under this section authorizes the holder to
provide alcoholic beverages at events that are held off the Class B restaurant or hotel
(on-sale) beer, wine and liquor license premises.

[(d)](E) The holder shall provide food as well as alcoholic beverages for
consumption at the catered event.

[(e)](F) A holder may exercise the privileges under this license only during the
hours and days that are permitted in this article for a Class B restaurant or hotel
(on-sale) beer, wine and liquor license [in Wicomico County].

[(f)](G) This section does not require a holder of an existing Class B restaurant
or hotel (on-sale) beer, wine and liquor license to have a caterer's license for catering on
the premises that is covered by the Class B license.
