(C) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, IN THE CASE OF A
MOTOR VEHICLE OR TRAILER THAT IS NOT LEASED, OR USED, PRIMARILY FOR
PERSONAL, FAMILY, OR HOUSEHOLD PURPOSES, A TRANSACTION DOES NOT
CREATE A SALE OR SECURITY INTEREST MERELY BECAUSE THE TRANSACTION
PROVIDES THAT THE RENTAL PRICE IS PERMITTED OR REQUIRED TO BE ADJUSTED
UNDER THE AGREEMENT EITHER UPWARD OF DOWNWARD BY REFERENCE TO THE
AMOUNT REALIZED UPON SALE OR OTHER DISPOSITION OF THE MOTOR VEHICLE
OR TRAILER CONTRACT ON WHICH THE TRANSACTION IS BASED CONTAINS A
TERMINAL RENTAL ADJUSTMENT CLAUSE.
SECTION 2. AND BE IT FURTHER ENACTED, That this. Act shall take effect
January 1, 1995.

AN ACT concerning
Administrative Procedure Act - Contested Cases - Corrective Changes
FOR the purpose of making certain corrections to Chapter 59 of the Acts of the General
Assembly of 1993, which revised the law relating to contested cases under the
Administrative Procedure Act; excluding the Patuxent Institution Board of Review
from those provisions of the APA when acting on parole requests; clarifying certain
provisions relating to the right to counsel; clarifying certain provisions relating to
interlocutory appeals; clarifying provisions relating to appeals' by State agencies;
clarifying the applicability of changes made by Chapter 59 of the Acts of 1993;
providing for the retroactive application of this Act; providing for the effective date
of this Act; and generally relating to the Administrative Procedure Act - Contested
Cases.
