(4) "Service deficit" means costs less:

(i) The greater of revenues collected under this section and §
10-205(b) of this subtitle or 50 percent of the costs; and

(ii) All federal operating assistance.

(b) Subject to the appropriation requirements and budgetary provisions of §
3-216 of this article and upon receipt of an approval of a grant application in the form or
detail as the Secretary shall reasonably require, the Department shall provide for annual
grants to Prince George's County and Montgomery County for eligible local bus service as
defined in this section. The amount of these grants shall be equal to;

(1) 100 percent of the service deficit attributable to each county; loss

(2) Each county's share of the Department's annual grant to the
Washington Suburban Transit District as determined under § 10-205(b) of this subtitle.

(c) (1) (A) IN THIS SUBSECTION SECTION;.. "COSTS" MEANS. ACTUAL
OPERATING OR EQUIPMENT COSTS AND AN ALLOWANCE FOR THE REPLACEMENT
OF VEHICLES USED TO PROVIDE PARATRANSIT SERVICE EQUAL TO THE COST OF
THE VEHICLES DIVIDED BY THEIR USEFUL LIFE:

(2) (B) SUBJECT TO THE APPROPRIATION REQUIREMENTS AND
BUDGETARY PROVISIONS OF § 3-216 OF THIS ARTICLE AND UPON RECEIPT OF AN
APPROVAL OF A GRANT APPLICATION IN THE FORM OR DETAIL THAT THE
SECRETARY REASONABLY REQUIRES, FOR FISCAL YEAR 1996 1995 AND EACH FISCAL
YEAR THEREAFTER
, THE DEPARTMENT SHALL PROVIDE ANNUAL GRANTS TO
LOCAL JURISDICTIONS THAT ARE REQUIRED UNDER THE FEDERAL AMERICANS
WITH DISABILITIES ACT TO PROVIDE PARATRANSIT SERVICE TO THAT IS
COMPLEMENTARY TO FIXED RATE ROUTE SERVICE. THE AMOUNT OF THESE
GRANTS SHALL BE EQUAL TO 100 PERCENT OF THE COSTS OF COMPLYING WITH
THAT ACT
GRANTS FOR PARATRANSIT SERVICE PROVIDED BY COUNTY OR LOCAL
GOVERNMENTS, THAT IS COMPLEMENTARY TO FIXED ROUTE SERVICE AS REQUIRED
UNDER THE FEDERAL AMERICANS WITH DISABILITIES ACT.           
             

(B) THE AMOUNT OF THE GRANTS:                                      

(1) SHALL BE IN ACCORDANCE WITH MULTIYEAR PARATRANSIT PLANS
APPROVED BY THE DEPARTMENT OR THE FEDERAL TRANSIT ADMINISTRATION; AND

(2) MAY NOT EXCEED A TOTAL OF $3.2 MILLION STATEWIDE IN FISCAL
YEAR 1995.                                               
                                 

(D) The Department's grant for any eligible local bus service UNDER THIS
SECTION may not be greater than the operating grant that the Department would incur
from the same bus service if operated by the Washington Metropolitan Area Transit
Authority. This requirement shall be applied on a line by line basis.
