(Senate Bill 638)

AN ACT concerning

Family Day Care - Registration Amnesty for Unregistered Providers

FOR the purpose of providing an amnesty for certain unregistered family day care
providers; requiring the Secretary of Human Resources to adopt certain guidelines
regulations; granting civil immunity to certain persons; providing that the Child
Care Administration of the Department of Human Resources make certain
recommendations; and generally relating to registration amnesty for certain family
day care providers.

Preamble                                                        

WHEREAS, Unregistered family day care providers are difficult to identify and
locate; and

WHEREAS, Cessation of child care services during the registration process is an
economic disincentive to registration; and

WHEREAS, The registration process frequently is prolonged due to. problems with
code compliance and administrative procedures; and

WHEREAS, Unregistered family day care providers, therefore, are reluctant to
become involved in the registration process; and

WHEREAS, It is the intent of the General Assembly that the State of Maryland
and the Child Care Administration of the Department of Human Resources should take
positive action, including a public information program; to encourage unregistered family
day care providers to comply with State laws governing child care; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

5-552.1.

(A) (1) THERE IS AN AMNESTY PERIOD, TO BE DETERMINED BY THE CHILD
CARE ADMINISTRATION OF THE DEPARTMENT, FOR UNREGISTERED FAMILY DAY
CARE PROVIDERS.
