(V) § 13-221 (DISCLOSURES TO SECRETARY OF STATE);

(VI) TITLE 16 (DEBARMENT OF CONTRACTORS); AND

(VII) TITLE 17(SPECIAL PROVISION STATE AND LOCAL

SUBDIVISIONS).

(3)      BANKING AND FINANCIAL SERVICES, INSURANCE, AND INSURANCE
SERVICES AS PROVIDED IN DIVISION I OF THE STATE FINANCE AND PROCUREMENT
ARTICLE AND ARTICLE VI, SECTION 3 OF THE MARYLAND CONSTITUTION SHALL BE
PROCURED THROUGH THE STATE TREASURER.

(4)      NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE BOARD
MAY PARTICIPATE IN STATE PROCUREMENT CONTRACTS.

(G) (1) ON THE RECOMMENDATION OF THE PRESIDENT, THE BOARD OF
REGENTS SHALL ESTABLISH AN INDEPENDENT PERSONNEL SYSTEM.

(2) TO CARRY OUT THE RESPONSIBILITIES OF THIS SECTION, THE

BOARD MAY:

(I) ESTABLISH, CREATE, AND ABOLISH POSITIONS;

(II) DETERMINE EMPLOYEE QUALIFICATIONS;

(III) ESTABLISH TERMS OF EMPLOYMENT, INCLUDING

COMPENSATION, BENEFITS, HOLIDAY SCHEDULES, AND LEAVE POLICIES; AND

(IV) DETERMINE ANY OTHER MATTERS CONCERNING EMPLOYEES.

(3)      THE PERSONNEL SYSTEM SHALL PROVIDE FAIR AND EQUITABLE
PROCEDURES FOR:

(I) THE REDRESS OF EMPLOYEE GRIEVANCES; AND

(II) THE HIRING, PROMOTION, AND TERMINATION OF EMPLOYEES
IN ACCORDANCE WITH LAW.

(4)      (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS
PARAGRAPH, AN EMPLOYEE OF THE UNIVERSITY QUALIFIES FOR AND SHALL
PARTICIPATE IN THE STATE EMPLOYEES' RETIREMENT AND PENSION SYSTEMS OR
THE STATE TEACHER'S RETIREMENT AND PENSION SYSTEMS.

(II) AN EMPLOYEE IN A POSITION DETERMINED BY THE BOARD TO
BE AN ADMINISTRATIVE, PROFESSIONAL, OR FACULTY POSITION MAY JOIN THE
OPTIONAL RETIREMENT PROGRAM UNDER ARTICLE 73B, § 110 OF THE CODE.

(F) (1) (I) ON THE RECOMMENDATION OF THE PRESIDENT, THE BOARD
OF REGENTS SHALL ESTABLISH GENERAL STANDARDS AND GUIDELINES
GOVERNING THE APPOINTMENT, COMPENSATION, ADVANCEMENT, TENURE, AND
TERMINATION OF ALL FACULTY, EXECUTIVE STAFF, AND PROFESSIONAL
ADMINISTRATIVE PERSONNEL IN THE MORGAN STATE UNIVERSITY.
