(g) The Department of Juvenile Services is responsible for the collection of
restitution payments when the restitution order provides that restitution is to be made in
periodic or installment payments, as part of probation, or pursuant to a work plan.

(A)     IN A RESTITUTION HEARING HELD UNDER § 3-829 OF THIS ARTICLE OR
ARTICLE 27, § 640 OF THE CODE, A WRITTEN STATEMENT OR BILL FOR MEDICAL,
DENTAL, HOSPITAL, FUNERAL, OR BURIAL EXPENSES SHALL BE PRIMA FACIE
EVIDENCE THAT THE AMOUNT INDICATED ON THE WRITTEN STATEMENT OR BILL
REPRESENTS A FAIR, REASONABLE, AND NECESSARY AND REASONABLE CHARGE
FOR THE SERVICES OR MATERIALS PROVIDED.

(B)     THE BURDEN OF PROVING THAT THE AMOUNT INDICATED ON THE
WRITTEN STATEMENT OR BILL IS NOT FAIR, REASONABLE, OR NECESSARY AND
REASONABLE SHALL BE ON THE PERSON CHALLENGING THE FAIRNESS;
REASONABLENESS, OR NECESSITY AND REASONABLENESS OF THE AMOUNT.

(B-1) THE PAYMENT OF INCOME TAX REFUNDS IS SUBJECT TO TAX REFUND
INTERCEPTION UNDER § 10-113 OF THE FAMILY LAW ARTICLE AND ARTICLE 19, §§ 43
THROUGH 46 OF THE CODE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.
